The Public Procurement and Supplies Administration Act B.E. 2560 (2017) establishes rules and regulations governing procurement activities of public organizations. While the act ensures transparency and effectiveness in public procurement, it may have limitations that hinder research and development efforts that require materials with specific technical requirements or unique expertise of contractors, which can lead to lengthy procurement processes and project delays.
To address these constraints, NXPO, in collaboration with the Comptroller General’s Department, has jointly developed procurement criteria for research and development and academic services that are not bound by the limitations of the Public Procurement and Supplies Administration Act B.E. 2560. The criteria were endorsed by the Policy Council and reflected in the notification officially announced in the Royal Gazette, becoming effective on 27 October 2023.
NXPO President Dr. Kitipong Promwong stated that these criteria will eliminate procurement restrictions and expedite research, development, and academic activities in higher education institutions, contributing significantly to the social and economic development of the country.
The notification allows procurement to be tailored to meet the needs of research, development, and academic service. This includes specifying procurement methods and conditions, increasing the maximum limit for the procurement by a specific method, and streamlining procedures. It also covers the procurement of biological or local materials with specific research requirements, the prepayment, and the procurement of materials sourced internationally. Furthermore, it allows for the transfer of materials to private entities in accordance with cooperation agreements.
